DOMAIN NAME REGISTRATION

By registering any hosting packages (annually) offered by our company (Global Hostings.net Limited) we will register 1 domain name of your choice ending in .com/ .net/.org/ .info/ .biz/ .us ONLY.

This domain name will be registered for 1 year only with the understanding that Global Hostings.net will retain the hosting rights of any or the registered domain name for 1 year.

CANCELLATION OF SERVICE

If you are not completely satisfied with our service, we will gladly give you a refund under our 30 Day Money Back Gaurantee. Please note, setup fees, if applicable, are non-refundable and current applicable domain registration cost will be deducted from your payment before we give you your refund if we registered any domain name for you.  

 

GHNHOSTING reserves the right to cancel, suspend, or otherwise restrict access to the account at any time with or without notice.

 

Exchange rate fluctuations for international payments are constant and unavoidable. All refunds are processed in U.S. dollars, and will reflect the exchange rate in effect on the date of the refund. All refunds are subject to this fluctuation and GHNHOSTING is not responsible for any change in exchange rates between time of payment and time of refund.

 

Customers may cancel at any time via a cancellation request located in your customer account.

 

Cancellations requested after the initial 30 days for Shared and Reseller accounts will go into effect on the renewal date for that particular hosting package. Unless specifically requested, the account will remain active until the period expires. If the account is eligible, any request for a refund outside of the initial 30 day period will be given on a prorated basis with any previous extended term discount withheld. Refunds are to be determined once the account has been canceled. Payments older than 60 days may require a refund via PayPal or mailed check due to our merchant account policies and procedures.

 

There are no refunds on dedicated servers, administrative fees, and install fees for custom software. Refund requests for .com, .net., and .org domain names (made within the 30 day money-back guarantee period) will have the common market value subtracted for those tld's. Any ccTLD's domain name purchases are non-refundable. Please note that domain refunds will only be considered if they were ordered in conjunction with a hosting package. Eligibility of said refunds will be determined at the time of cancellation.

 

Only first-time accounts are eligible for a refund. For example, if you've had an account with us before, canceled and signed up again, you will not be eligible for a refund or if you have opened a second account with us.

 

Dedicated IP Address Allocation
Any dedicated IP order in addition to ones provided with a hosting package may be subject to IP Justification. Justification practices are subject to change to remain in conformity with policies of American Registry for Internet Numbers (ARIN). We reserve the right to deny any dedicated IP request based on insufficient justification or current IP utilization.

 

Third Party Providers
All transactions with third party providers are solely between the visitor and the individual provider. GHNHOSTING.COM is not the agent, representative, trustee or fiduciary of you or the third party provider in any transaction.

 

All discounts, promotions and special third party offers may be subject to additional restrictions and limitations by the third party provider. All transactions with third party providers are subject to the terms and conditions under which the provider agrees with you to provide the goods or services. You should confirm the terms of any purchase and/or use of goods or services with the specific provider with whom you are dealing.

 

We do not make any representations or warranties regarding, and are not liable for, the quality, availability, or timeliness of goods or services provided by a third party provider. You undertake all transactions with these providers at your own risk. We do not warrant the accuracy or completeness of any information regarding third party providers.

 

UNACCEPTABLE CONTENT

All services provided by Global Hostings may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute. The subscriber agrees to indemnify and hold Global Hostings harmless and our employees from any claims resulting from the use of the service which damages the subscriber or any other party.

Examples of unacceptable content or links:

- Pornography and sex-related merchandising.
- Pirated software.
- Hacker programs or archives.
- Warez sites.
- MP3 Sites.

Pornography and sex-related merchandising is prohibited on all our web hosting servers. This includes sites that may infer sexual content, or link to adult content elsewhere. We will be the sole arbiter in determining violations of this provision.

 

It is your responsibility to ensure that scripts/programs installed under your account are secure and permissions of directories are set properly, regardless of installation method. When at all possible, set permissions on most directories to 755 or as restrictive as possible. Users are ultimately responsible for all actions taken under their account. This includes the compromise of credentials such as user name and password. It is required that you use a secure password. If a weak password is used, your account may be suspended until you agree to use a more secure password. Audits may be done to prevent weak passwords from being used. If an audit is performed, and your password is found to be weak, we will notify you and allow time for you to change/update your password.

 

Spamming

Spamming, or the sending of unsolicited e-mail including, without limitation, commercial advertising and informational announcements, from our server or using an e-mail address or domain that is maintained on our machine as reference is STRICTLY prohibited. We will be the sole arbiter as to what constitutes a violation of this provision. A user shall not use another site's mail server to relay mail without the express permission of the site. We will be the sole arbiter as to what constitutes a violation of these provisions.

 

Unlimited Hosting/Bandwidth Myth

It's true, no one can provide truly unlimited web hosting, but when we say unlimited domains, disk space or bandwidth, of course there are terms & conditions that you must adhere to. Accounts with unlimited features may not to be used to host a collection of MP3s, videos, anime, Warez, or to backup your computer or another source. They may not be used for general storage of any type. All content stored on an unlimited account must be directly used on the Internet by the website associated with that account. These accounts may not be used as a download distribution point for your software or media. They are to be used for standard web practices only. This means that all content stored on an unlimited account must be used for "acceptable" website use.

“Unacceptable” usage is anything that a shared server would not be able to provide under standard circumstances. If all disk space used is for acceptable websites, and all bandwidth used is for acceptable activity, then when we run out of disk space and/or bandwidth, we simply add more. Of course you are not the only client we have to think about, so while your business grows, so do theirs, but so does ours. And this is the way in which we can continue to upgrade our resources to provide the "unlimited" promise.

However of course, you must be thinking that a server can only be upgraded with the latest processors up to a certain limit, and disk space can be only added until there is no more space or slots to add more. We don't know when or if that will ever be reached on our servers as we constantly load balance our servers to ensure an even distribution of accounts, but we do concede that if it does ever reach such a stage or if your account requires resources that are not able to be provided by a shared server, then in such circumstances we may require you to rent a dedicated server. Any professional and reliable host would say the same thing, you can check around for yourself.

And anyway, if you are very successful, which is very likely given the massive Internet expansion globally with you ending up hosting hundreds of domains if not thousands, then you would already be in a financial position to explore a variety of options to expand even further. And of course we would be there happy to help you.

LIMITATION OF LIABILITY.
NOTHING IN THIS AGREEMENT SHALL BE CONSTRUED TO CONSTITUTE A WARRANTY, EXCLUSIVE OF SUCH SPECIFICALLY DESCRIBED HEREIN. GHNHOSTING.COM'S MAXIMUM LIABILITY TO YOU UNDER THIS AGREEMENT, AND YOUR EXCLUSIVE REMEDY FOR ANY CAUSE WHATSOEVER, REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT OR IN TORT INCLUDING NEGLIGENCE, WILL BE LIMITED TO THE RECOVERY OF ACTUAL DAMAGES UP TO THE TOTAL AMOUNT OF $250. IN ADDITION, GHNHOSTING.COM SHALL NOT BE LIABLE TO YOU FOR LOST PROFITS OR SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES WHETHER BASED IN CONTRACT OR TORT (INCLUDING NEGLIGENCE, STRICT LIABILITY OR OTHERWISE), AND WHETHER OR NOT ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. GHNHOSTING.COM MAY SEEK INJUNCTIVE RELIEF TO PREVENT YOU FROM DISSEMINATING GHNHOSTING.COM'S CONFIDENTIAL INFORMATION OR FROM UNAUTHORIZED USE OF GHNHOSTING.COM'S TRADE NAME OR TRADEMARKS.

 

NO WARRANTIES.
GHNHOSTING.COM PROVIDES ALL MATERIALS AND THE SERVICES TO YOU AND ITS SUBSCRIBERS "AS IS." GHNHOSTING.COM MAKES NO OTHER WARRANTIES AND GHNHOSTING.COM DISCLAIMS ALL WARRANTES AND CONDITIONS, EXPRESS, IMPLIED OR STATUTORY, INCLUDING WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE. GHNHOSTING.COM DOES NOT WARRANT THAT THE SERVICES OR SIGN-UP PAGE WILL BE INTERRUPTED OR ERROR FREE, NOR DOES GHNHOSTING.COM MAKE ANY WARRANTY AS TO THE PERFORMANCE OR ANY RESULTS THAT MAY BE OBTAINED BY USE OF THE SERVICES OR THE SIGN-UP PAGE. In addition, there are no guarantee's made on actual profit that can be made through our reseller plans. Any profit calculations are only examples and are not guaranteed. All resellers are Independent Contractors.

 

Indemnification
Customer agrees that it shall defend, indemnify, save and hold GHNHOSTING harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against GHNHOSTING, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless GHNHOSTING against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with GHNHOSTING; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customers from GHNHOSTING's server.

 

Agreement

By activating your account with us, you agree to the above policies and disclaimer. Upon requesting an account activation, you are required to accept these policies, guidelines, and disclaimer and a copy of your acceptance is forwarded along with your activation request to be maintained within your account information.

NOTICE: If you sign up for an account and do not follow our terms, no refunds will be given. We will however let you know by email or phone before any action is taken so that you have the opportunity to resolve the matter.

We retain the right to change any or all of the above Policies, Guidelines, and Disclaimer without notification.
